The big irony of this case is being completely missed by the press.

If APIs are copyrightable, then Oracle's entire database business would be placed at risk, since Oracle's database uses an API (SQL) that was created by IBM and has been assumed for decades to be free for anyone to use. If that were to change...

The reason I see Oracle as fighting an uphill battle for an appeal is because Judge Alsup presumably has a better than average understanding of the issues in the case. Oracle will have to figure out how to claim that there is more to the case than Judge Alsup was able to consider. That doesn't sound very easy to do.
