I am not an Instagram user, but my photo and those of my family are likely on several Instagram user accounts. Who can they use my likeness or my families if I haven't expressly agreed?

Instagram loop hole: All you need to do is tag your photo with a TOS at the footer of your photos. Example: "Property of yournamehere, TOS at http://yourtermsofuse.com/here.

As long as your photos have a terms of use on it before using their services they can not use it or sale it.

Intragram will be getting sued over this facebook tried this and was slapped for trying.

Just remember boys and girls... whenever you use one of these so called free services like Facebook or Instagram you don't become their customer you become their INVENTORY.

And odds are Instagram will change their tune as soon as one of our elected congress-slime finds out that an image of theirs might be used without permission and without suitable excessive compensation.

even if your work is copyrighted and you put it on instagram, if you are the copyright holder, according to the TOS you sign to use Instagram, they can still use it without paying you. The only time they cant use it is if the copyright holder can prove they copyrighted it and that someone else put it on instagram. In that case, the person who uploaded it can be sued, but Instagram cannot, but the copyright holder can stop Instragram from using it if they inform them. That TOS nonsense is about as much hoopla as those people who posted status updates saying they copyright all their facebook material.
