Ultimately it depends on which side of the fanboy divide you are on. If you are on the apple side samsung might feel at fault to you, if you are on the samsung side apple might feel at fault to you.

What exactly did Samsung copy from Apple? All the courts in the world appear to agree that Samsung didn't copy Apple. Except for the one 20 miles from Apple's headquarters in Cupertino. And that one isn't finished yet... As a matter of law. Unfortunately, regardless of the outcome, it is sure to be appealed by either Apple, or Samsung.

I've said it all along since I've joined PC World forums back in January 2009, the one company Apple cannot and should not take on for a fight, is Samsung. I'll dig it up someday.
Now look at what is happening in reality. Most of Apple patents are 'design' patents, focusing on 'silly' look and feel. But nothing technically significant behind.
How much technical R&D does Apple spends per year? How much does it cost to design a Louis Vuitton handbag? Or the Swiss Railways clock?
According to this Global Innovation 1000: Top 20 R&D Spenders 2004-2011, Apple isn't even on the list. Sorry. Just facts. Only facts.

Apple have lost their originality and are funded purely by their fan boy status. They counter this by patenting every single pathetic little thing and then suing anyone who uses anything remotely similar. I honestly don't know who's worse: The people that grant the patents, the people who fund Apple's unoriginal and pathetically outdated technology or the courts who allow this behaviour to continue without consequence.
Apple should be fined or counter sued half the amount they try to weasel out of other companies every time they have a denied case.
