The EFF staff attorney is either wrong or didn't read the La Russa suit. Section 230 does give immunity to social networks for certain things. However, section 230 specifically says that section 230 does not have an effect on intellectual property law. La Russa is suing for several privacy and trademark claims...all fall outside of section 230 protection.

Sorry, EFF was talking about Craigslist - so it's not them. The author of this article is wrong. The above still applies. Trademark falls outside section 230 protection.
