No matter how the law finally gets settled, local "cowboy" district attorneys will continue to seize equipment and let the courts hash it out later.

There is NO valid or legal reason for them to have not returned the computers with in days of confiscating them. All that they needed to do was make a forensics copy of the hard drives for use in their investigation once the legalities were hashed out. He was deprived of access to the data on it that had nothing to do with the case for 3 months. If they wanted to maintain physical possession of the hardware as well as the data contained in it, he is entitled to a backup/copy of the data for his used while the police screw around with the equipment.
Normal procedure in case of this type is to supply such a copy of the sized data.

The only reason it took so long for Chen's stuff to get released is because Apple threw it's weight around. Who has more resources? Apple, tech industry giant, or a lowly tech blogger? Come on. And, oh look, his stuff is only being released AFTER Apple released their new iPhone 4. Very convenient for them, huh?
