Intel Hit with Patent Suit

According to the article:
---
Intel has refused to enter into a license agreement with WARF related to the patent, according to court documents. WARF said had made repeated attempts to offer Intel legal licensing opportunities for the technology.
The suit came as a surprise to Intel.
---
Why was Intel surprised? Intel kept telling WARF, "We're not going to license this technology" and then are surprised when an infringement lawsuit is filed? What in the world did they expect??
Also in the article:
---
"We were in discussions with WARF for more than a year on this issue. However [we] did not expect this suit," Intel spokesman Chuck Mulloy said via e-mail.
---
In discussion? About what? Their refusal to pay for licensing? Sounds more like a stalling tactic to me.
