This article was really badly written. The author could have saved us a lot of time by writing the article as a single page. What a waste of time.

the requirement that "applications may not be designed or marketed for real-time route guidance; automatic or autonomous control of vehicles, aircraft, or other mechanical devices" is a violation of both fair use and the rights of first sale and thus invalid. it is also a blatant attempt by apple to monopolize the gps guidance software market and thus illegal. it is also a good example of why i'll never be buying an iphone. windows mobile isn't perfect, but at least microsoft isn't as fascist and greedy as apple is.

similarly, since CityRail is a government and thus publicly owned entity, its schedules are public domain and it has no claim of copyright violation.

I agree with the opinion of EdwardVirtually .

Just because Apple says it is illegal doesn't necessarily make it so. Illegal EULA's have been overturned by the courts. Case precedent? Look at the DOJ vs Microsoft and their shrink-wrap EULA's...

What appears illegal are the monopolistic and cartel like tendencies demonstrated by Apple. Especially when they have the gull to publish open-source for the iPhone.

People are not licensing the iPhone. They purchased it, hardware, firmware and all. They own it. And can do as they please with it. Maybe they can't make money off it. But they can certainly load or create whatever they want on their legally purchased property. We are not talking about software here. The iPhone is a hardware device. Period.
